ILGA calls for the repeal of the decree that modifies the Gender Identity Law: “It ignores scientific evidence and puts trans youth at risk.”

ILGA, the world's largest LGBTQ+ organization, condemned the amendment to the Gender Identity Law. It called for the decree to be repealed and urged organizations and institutions to take a stand.

The International Lesbian, Gay, Bisexual, Trans and Intersex Association for Latin America and the Caribbean (ILGALAC) and ILGA World condemned Decree of Necessity and Urgency 62/2025 issued by the government of Javier Milei to modify the Gender Identity Law. In a joint statement, they explained that this decree “ imposes serious restrictions on the right to gender identity for trans and non-binary people , particularly young people.” They also stated that another decree (61/2025), published in the Official Gazette on the same day, which restricts the gender identity of people deprived of their liberty, “violates the dignity of trans people deprived of their liberty,” noting that both decrees were issued days after a massive anti-fascist Pride march .

ILGA, the world's largest LGBTQ+ organization, recognizes the progressive nature of Gender Identity . It is "the first in the world to allow for name and gender marker changes based on self-identification standards and the right to comprehensive healthcare," the organization stated. ILGA denounced the proposed amendment to the Gender Identity Law, calling it "an alarming setback in human rights and a direct attack on the principles of equality and non-discrimination enshrined in the National Constitution, international human rights treaties, and the Gender Identity Law itself (Law 26.743), recognized worldwide as a leading example."

Legal experts explained to Presentes that these decrees, as also stated in the ILGA and ILGALAC Declarations, “ do not comply with the Constitution . They point out that organizations in Argentina denounce that the elimination of national prevention policies, the closure of key institutions, and the suppression of hate speech by the national government have created a scenario where “ cases of bias-motivated violence have increased” and “ living conditions for the LGBTI community have worsened .

The organization that maps the human rights of LGBTIQ+ people worldwide states that “ the restriction imposed on trans youth accessing essential medical treatments ignores scientific evidence and recommendations from international bodies such as the World Health Organization (WHO) and the Inter-American Commission on Human Rights (IACHR).” In addition to disregarding the progressive autonomy of young people, the decree “ exposes trans youth to greater levels of vulnerability, psychosocial suffering, and the risk of clandestine and unregulated medical practices .

Regarding the decree that regulates the housing of trans people in prisons, it says that it promotes the stigmatization and criminalization of diversity , by relying on an isolated case to justify regressive measures that threaten the safety and fundamental rights of the trans population deprived of liberty.

“Abuse of power and a blow to the institutions”

For ILGA, this regression, implemented through a decree, is “an abuse of executive power and a blow to democratic institutions .” The organization, which brings together hundreds of groups, urges the international community, human rights bodies, and the Inter-American human rights system to “ speak out strongly against these decrees and demand their immediate repeal.”

It also calls on Congress to reject these decrees and on the Supreme Court of Justice of the Nation "to assume its responsibility in defending fundamental rights and guarantee the full implementation of the Gender Identity Law in its original wording." Constitutional law expert Andrés Gil Domínguez had also expressed a similar opinion, requesting the intervention of the highest court in the judicial branch.

We will not tolerate the normalization of hate speech and policies that endanger the lives and dignity of trans people. We will remain steadfast in the fight for equality and justice, and we will support all necessary legal and advocacy actions to stop this authoritarian onslaught. Trans lives are not negotiable. Hard-won rights will not be relinquished,” the statement reads.
