ILGA calls for the repeal of the decree amending the Gender Identity Law: "It ignores scientific evidence and exposes trans youth."

The International Lesbian, Gay, Bisexual, Trans and Intersex Association for Latin America and the Caribbean (ILGALAC) and ILGA World condemned the Decree of Necessity and Urgency 62/2025 issued by Javier Milei's government to amend the Gender Identity Law. In a joint statement, they explained that this decree " imposes serious restrictions on the right to gender identity of trans and non-binary people , particularly young people." They also said that the other decree (61/2025) published in the Official Gazette on the same day, which conditions the gender identity of people deprived of liberty, "violates the dignity of trans people deprived of liberty," highlighting that both were issued days after a massive anti-fascist Pride march .
ILGA, the world's largest sexual diversity organization, recognizes the progressive human rights impact of Gender Identity . It is "the first in the world to allow for name and gender marker changes under self-identification standards and the right to comprehensive health," it stated. It also denounced the amendment to the Gender Identity Law as "an alarming setback in human rights and a direct attack on the principles of equality and non-discrimination enshrined in the National Constitution, international human rights treaties, and the Gender Identity Law 26.743 itself, recognized worldwide as a cutting-edge model."
Legal experts explained to Presentes that these decrees, as stated in the ILGA and ILGALAC Declaration, " do not comply with the Constitution . They also point out that organizations in Argentina denounce that the elimination of national prevention policies, the closure of key institutions, and the encouragement of hate speech by the national government have created a scenario where " cases of violence due to prejudice have increased" and " the living conditions of the LGBTI community have worsened .

Regarding the decree regulating the housing of trans people in prisons, he says it promotes the stigmatization and criminalization of diversity by relying on an isolated case to justify regressive measures that violate the safety and fundamental rights of the incarcerated trans population.
“Abuse of power and a blow to institutionality”


For ILGA, this regression, implemented through a decree, is "an abuse of executive power and a blow to democratic institutions ." The organization, which represents hundreds of groups, urges the international community, human rights organizations, and the Inter-American system for the protection of human rights to " speak out strongly against these decrees and demand their immediate repeal."
He also calls on Congress to reject these decrees and on the Supreme Court of Justice of the Nation , "so that it assumes its responsibility in defending fundamental rights and guarantees the full validity of the Gender Identity Law in its original wording." Constitutionalist Andrés Gil Domínguez had also expressed a similar opinion, calling for the intervention of the highest body of the Judiciary.
“ We will not tolerate the normalization of hate speech and policies that endanger the lives and dignity of trans people. We will remain steadfast in the fight for equality and justice, and we will support all legal and advocacy actions necessary to halt this authoritarian onslaught. Trans lives are not for negotiation. Rights won cannot be rolled back,” the statement reads.
