A lesbian couple and mothers of twins filed a protection action today in the Santiago Court of Appeals against the Civil Registry for refusing to register the children with both of their surnames and for ignoring their dual motherhood, the Movement for Homosexual Integration and Liberation (Movilh) reported.

A lesbian couple and mothers of twins filed a protection action today in the Santiago Court of Appeals against the Civil Registry for refusing to register the children with both of their surnames and for ignoring their dual motherhood, according to the Movement for Homosexual Integration and Liberation (Movilh).
The couple entered into a civil union on November 21, 2018, and the children were born on September 20, 2017, after they underwent an artificial insemination process with an anonymous donor.
“The civil servant only gave us the option of registering our children with one of our last names. We were very nervous because our children were hospitalized at the time, and we didn't realize the civil servant was making a mistake by denying us the possibility of registering them with both of our last names,” said one of the affected mothers. When the mothers returned to the Civil Registry to correct the error, they were told it was no longer possible. The reason given was that the law prohibits it.
Movilh lawyer Mónica Arias, who is representing the couple, said that the rights to equality before the law, the right to life and physical and mental integrity, the right to family, the best interests of the child, and non-discrimination, guaranteed by both national laws and international treaties or resolutions ratified by Chile, are being violated.
The presentation made before the Court requests that the children's birth certificates be rectified with the women's surnames and that dual maternity be recognized.
