#Chile Municipal employees in Providencia must respect the chosen name of transgender people

The Municipality of Providencia approved a circular indicating that officials working in the municipality must refer to trans people by their name and social identity and not by the registered name (the one that appears on the identity card).

“The name and sex that appear on the identity card (which we know as the registered name and sex) may not match the gender identity self-perceived by some trans people.” And it adds: “When this happens, trans people assume a social name and gender that deserves to be respected in the care and treatment they receive.”

The measure was an initiative of the Providencia Diversity Office, which stated in a circular that “this administration reiterates the need to understand and apply Law No. 20.609, which establishes measures against discrimination, in line with the spirit of service and quality care that constantly guides this municipality.” They also indicated that “when a trans person states that they have a name and gender identity different from their registered gender, this should not be questioned and will be recorded in the corresponding municipal service records.”

They clarified that the document will only be valid for procedures related to the municipality itself, such as obtaining a resident card, accessing activities, etc. However, it will not be valid for procedures related to the central administration, such as driver's licenses or others, for which the valid document will continue to be the National Identity Card.
